1. Acceptance of Terms
By accessing or using Real Estate Landmark, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the service or the marketplace. These terms apply to all visitors, users, buyers, sellers, and renters on the platform.
2. User Accounts & KYC
To access certain features, including posting property listings, you must register for an account. Real Estate Landmark enforces strict Know Your Customer (KYC) verification policies to maintain a secure, scam-free ecosystem. You are solely responsible for safeguarding your account credentials, OTPs, and wallet balance. We will never ask for your password or OTP outside of the official login screen.
3. Platform Role & Safe Harbor
Real Estate Landmark operates solely as a technological facilitator and marketplace. We do not own, hold, inspect, or guarantee the condition, legality, title, or authenticity of any property listed. All transactions, negotiations, documentation, and payment settlements are strictly between the buyer and the seller. Real Estate Landmark shall not be held liable for any financial loss, legal disputes, or damages arising from user interactions.
4. Prohibited Content
You agree not to post listings that include or promote:
- Properties you do not legally own or have authorization to list.
- Fraudulent, duplicate, or misleading property listings.
- Properties subject to unresolved legal disputes, unless clearly disclosed.
- Offensive, discriminatory, or unlawful content.
- Financial scams, multi-level marketing (MLM) schemes, or fraudulent offers.
5. Wallet & Payments
Wallet credits are a closed-loop digital utility used exclusively for purchasing premium ad placements (Featured, Urgent, Sticky) and listing fees on the platform. They hold no real-world fiat cash value, cannot be withdrawn to a bank account, and are non-transferable between user accounts. All purchases of wallet credits via our payment gateways (Razorpay, PhonePe, PayPal, Stripe, etc.) are subject to our Refund Policy.
6. Fair Usage
To maintain high-quality inventory, Real Estate Landmark enforces posting limits. Individual users are granted a specific number of free listings based on the category. Once the limit is reached, a listing fee applies. Attempting to bypass listing fees by reposting the same property under multiple accounts will result in immediate deletion of the listings and possible account suspension.
7. Intellectual Property & Copyright
All content, logos, graphics, and software on Real Estate Landmark are the exclusive property of the platform or its licensors. You may not extract, reproduce, or commercially exploit any platform data, including scraping listings, without explicit written permission. By posting content on the platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your listings for promotional and operational purposes.
8. Privacy and Data Protection
Your privacy is important to us. By using Real Estate Landmark, you consent to the collection, storage, and processing of your personal data, including KYC documents and transaction history, as outlined in our Privacy Policy. We employ industry-standard security measures but cannot be held liable for unauthorized breaches beyond our reasonable control.
9. Refund and Cancellation Policy
Payments made for wallet credits, premium ad placements, or listing fees are generally non-refundable. Refunds will only be processed in the event of technical gateway failures where payment was deducted but services or credits were not credited to your account. Listing takedowns or account bans due to policy violations (such as posting Prohibited Content) do not qualify for refunds of any kind.
10. Limitation of Liability
To the maximum extent permitted by law, Real Estate Landmark shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform. This includes damages for loss of profits, data, or goodwill, regardless of whether we have been advised of the possibility of such damages. You use the platform strictly at your own risk.
11. Account Termination
Real Estate Landmark reserves the right to suspend or permanently ban any user account, forfeit wallet balances, and remove listings without prior notice if our moderation team detects fraudulent activity, spam, circumvention of fees, or a direct violation of these Terms of Service.
12. Modifications to Terms
We reserve the right to update, modify, or replace these Terms and Conditions at any time to reflect changes in our services or legal requirements. We will notify users of significant changes via the platform. Continued use of Real Estate Landmark after any such changes constitutes your formal acceptance of the new Terms.
13. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from the use of this platform shall be subject to the exclusive jurisdiction of the courts in Visakhapatnam, Andhra Pradesh.
